TERMS OF SERVICE

1. AGREEMENT TO TERMS

By accessing patientrecapture.com or using our services, you agree to these Terms of Service. If you disagree, do not use our services.

2. SERVICES PROVIDED

PatientRecapture provides automated consultation booking systems for dental practices. Services include:

  • HubSpot workflow implementation
  • Email and SMS follow-up automation
  • Consultation booking optimization
  • Set up, training, and support

3. SUBSCRIPTION AND BILLING

Monthly subscription: $297-$797/month (based on plan) – Billing: Monthly via Stripe – Payment due: First of each month – Auto-renewal: Yes, unless cancelled – Cancellation: 30 days written notice required – No refunds for partial months

4. 90-DAY GUARANTEE

If our system doesn’t recover at least 5 additional consultations within 90 days, you receive a full refund of all fees paid. To claim:

  • Email hello@patientrecapture.com within 90 days of setup
  • Provide consultation booking data
  • Refund processed within 14 business days

5. CLIENT RESPONSIBILITIES

You agree to:

  • Provide accurate practice information
  • Have an active CRM (HubSpot or compatible)
  • Maintain a minimum of 20 monthly implant inquiries
  • Respond to consultation bookings promptly
  • Pay subscription fees on time

6. INTELLECTUAL PROPERTY

All workflows, templates, and materials remain PatientRecapture property. You receive a license to use them during active subscription only.

7. DATA AND PRIVACY

  • We process patient contact data per our Privacy Policy
  • You remain the data controller
  • We are the data processor
  • HIPAA compliance: You are responsible for ensuring compliance
  • We don’t access protected health information (PHI)

8. LIMITATION OF LIABILITY

PatientRecapture is not liable for:

  • Lost revenue or business opportunities
  • Data breaches at your practice
  • Third-party service failures (HubSpot, Twilio, etc.)
  • Results varying from estimates

Maximum liability: Total fees paid in the previous 3 months

9. TERMINATION

We may terminate if you:

  • Fail to pay
  • Violate these terms
  • Use services fraudulently
  • Provide false information

You may terminate with 30 days written notice.

Upon termination:

  • Access to workflows ends immediately
  • No refunds for the remaining month
  • Data export available for 30 days

10. NO MEDICAL ADVICE

We provide marketing automation, not medical advice. All patient care decisions remain with licensed dental professionals.

11. MODIFICATIONS

We may update these terms with 30 days’ notice via email. Continued use constitutes acceptance.

12. GOVERNING LAW

These terms are governed by Texas law. Disputes resolved in Dallas County, Texas courts.

13. ENTIRE AGREEMENT

These terms, plus our Privacy Policy, constitute the entire agreement.
